THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES, ERRORS, OR TYPOGRAPHICAL ERRORS. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OUR SITE, OR FIVE DOLLARS ($5.00), WHICHEVER IS LESS, REGARDLESS OF THE FORM OF ACTION.

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS EBICYCLES.AI, ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS, AND ITS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, SUPPLIERS, SUCCESSORS, AND ASSIGNS FROM AND AGAINST ANY CLAIMS, LIABILITIES, DAMAGES, JUDGMENTS, AWARDS, LOSSES, COSTS, EXPENSES, OR FEES (INCLUDING REASONABLE ATTORNEYS' FEES AND COURT COSTS) ARISING OUT OF OR RELATING TO:

• Your violation of these Terms of Service;
• Your use of the Site, including, but not limited to, your User Contributions;
• Any use of the Site's content, services, and products other than as expressly authorized in these Terms;
• Your use of any information obtained from the Site;
• Any accidents, injuries, damages, or losses resulting from the application of information found on this Site;
• Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property or privacy right;
• Any claim that your User Contribution caused damage to a third party;
• Any decision made or action taken by you in reliance on the content available on the Site.

YOU FURTHER REPRESENT AND WARRANT THAT YOUR USER CONTRIBUTIONS DO NOT VIOLATE ANY THIRD-PARTY RIGHTS, INCLUDING COPYRIGHT, TRADEMARK, PRIVACY, PUBLICITY OR OTHER PERSONAL OR PROPRIETARY RIGHTS, AND DO NOT CONTAIN ANY MATERIAL THAT COULD GIVE RISE TO CRIMINAL OR CIVIL LIABILITY UNDER APPLICABLE LAWS.

WE HAVE THE ABSOLUTE RIGHT TO REMOVE ANY USER CONTRIBUTIONS AT OUR SOLE DISCRETION, FOR ANY OR NO REASON WHATSOEVER, AND WITHOUT NOTICE TO YOU. WE HAVE NO LIABILITY FOR ANY USER CONTRIBUTIONS POSTED BY YOU OR ANY THIRD PARTY.

THE ARBITRATION SHALL BE ADMINISTERED BY JAMS PURSUANT TO ITS COMPREHENSIVE ARBITRATION RULES AND PROCEDURES. JUDGMENT ON THE AWARD MAY BE ENTERED IN ANY COURT HAVING JURISDICTION.

ARBITRATION MEANS THAT YOU PERMANENTLY AND IRREVOCABLY WAIVE YOUR RIGHT TO A JUDGE OR JURY TRIAL IN A COURT PROCEEDING AND YOUR GROUNDS FOR APPEAL ARE LIMITED.

THE ARBITRATOR MAY, IN THE AWARD, ALLOCATE ALL OR PART OF THE COSTS OF THE ARBITRATION, INCLUDING THE FEES OF THE ARBITRATOR AND THE REASONABLE ATTORNEYS' FEES OF THE PREVAILING PARTY.

CLASS ACTION WAIVER: ANY CLAIMS BROUGHT BY EITHER PARTY MUST BE BROUGHT IN THAT PARTY'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING. YOU ACKNOWLEDGE THAT BY AGREEING TO THESE TERMS, YOU AND EBICYCLES.AI ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION ON PARTICIPANT OR BENEFICIARY RIGHTS TO BRING AN ACTION AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IN THOSE JURISDICTIONS, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU RESIDE IN SUCH A JURISDICTION, YOU EXPLICITLY WAIVE ANY RIGHT YOU MAY HAVE TO A TRIAL BY JURY.

TIME LIMITATION: YOU AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO USE OF THE SITE OR THESE TERMS MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR BE FOREVER BARRED.

12. Waiver and Severability

No waiver by us of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of us to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect. THE INVALIDITY OF ANY PROVISION OF THESE TERMS SHALL NOT AFFECT THE ENFORCEABILITY OF ANY OTHER PROVISION OF THESE TERMS, WHICH SHALL REMAIN IN FULL FORCE AND EFFECT.

13. Assumption of Risk

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE IS AT YOUR SOLE RISK. YOU EXPRESSLY ACKNOWLEDGE THAT E-BIKE ACTIVITIES ARE INHERENTLY DANGEROUS AND INVOLVE SIGNIFICANT RISK OF PERSONAL INJURY, DEATH, AND PROPERTY DAMAGE. BY ACCESSING THE SITE, YOU KNOWINGLY, WILLINGLY, AND VOLUNTARILY ASSUME ALL RISKS RELATED TO SUCH ACTIVITIES, EVEN IF SUCH RISKS ARISE FROM THE NEGLIGENCE OR FAULT OF EBICYCLES.AI OR OTHERS, AND ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE SITE.

14. Entire Agreement

These Terms, our Privacy Policy, and any other terms and policies referenced herein constitute the sole and entire agreement between you and eBicycles.ai regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
